I'm sorry Hogscape, what "that guy" is doing with your game is reprehensible.
There must be some way to stop him selling it on Amazon, heck could we all put statements in the comments section telling about "that guy"'s IP theft and the authors wish not to have his game sold without his permission?

Hey, I started a discussion on the amazon product page, pointing out that Ken and Rick both have said his license is terminated. Might want to join in the chorus on that.

Just as a follow up to an earlier post, it appears that David Ullery, mentioned as a possible confederate / sockpuppet of "that guy", is in fact another victim. Posts and e-mails at Trollhalla suggest that his name (and an e-mail address using his name, but not owned by him) have been used to send the e-mail to Ea, but that he was entirely uninvolved, other than having done some art for "that company".

"that guy"'s response to Aramis' post on the Amazon page is...interesting.
Rick confirmed on Trollhalla (or was it RPG.net) that T&T is indeed wholly trademarked. That the misunderstanding of the lapsed and untrademark-ed-ness...just and only referred to the trademark for the computer game and/or with regards to that company or something. (New World?...was that who it was?...anyway...)
"that guy" claims one can "check with the Library of Congress" but, if I recall correctly, that's where the info came from when it was misunderstood that the trademark had been allowed to lapse, which is what caused Rick to verify that that trademark only had to do specifically with the computer game.
Anyhow, I've sent an email to Rick about it with links to the product page and discussion/claim so that he may respond himself or otherwise confirm to the community so that we can respond with authority as we may.

That is insane, and I wonder if that could be the final nail in "that guy"'s coffin. I mean, if you sell a $20 rip-off book you could get into trouble but if it's over $1300 I'm betting it gets into a whole other realm of the law. That's major fraud, I would guess, and it will be interesting to se if it goes farther than just e-bay.

The felony threshold is a variable target. It is, however, federal interstate commerce, and thus federal fraud.
I hope the buyer files an ebay fraud complaint. Ebay will go after him, once Ken's contacted to verify authenticity (or the lack therof).

Holy Soda Popinski.... that's insane. I hope that poor guy gets his money back. This whole thing is just turning out to be a nightmare for all parties involved.
If he paid that price, he must have been a HUGE T&T fan.

I can see a true fan with loads of groats wanting a copy of the very first edition - I never knock a collector.
In fact a group of dedicated collectors should hire a hit man...
Clearly a criminal act and seemingly more blatant that previous transgressions. This is akin to clubbing the guy in the street and stealing his wallet.

Just saw this on the 'walla... Horrible. But I was...almost laughing at the absurdity of it all. Plus, I briefly entertained the thought some days back that I wondered if the item in the auction was even legit and how funny it would be if the moron sent the winner one of the obviously new, slick, CreateSpace or Lulu-printed first editions. Not exactly the same outcome, but so close as to be barely noticeable, so I had to laugh for someone doing something that someone does in, like...a bad comedy movie or something... What a...what an absolute [tons of things I can't say here no matter how cleverly I may fool the word filter because I may actually make it explode]! I've still yet to receive a response from Rick about the Amazon deal and "that guy" still insists on the trademark not being existent in the Library of Congress, etc.

Yeeeesh. "that guy" continues to plumb the very depths of the concept "sleazeball". And, unless I'm mistaken, the party who got taken is one of the founders of Tome of Treasures. i.e. "that guy" shafted the very person, outside of maybe one of the original T&T players, most able to TELL this was a cheap repro. The Gods of Irony are pleased. ;D
